Personal Data Protection Clarification Text

In accordance with the Law No. 6698 on the Protection of Personal Data (“KVKK”), your personal data is processed by the person operating the Bircep service (data controller) within the scope described below. This text is provided for informational purposes as per Article 10 of the KVKK.

1. Nature of the Service (Important)

This site may be operated for personal or hobby purposes; the infrastructure may be hosted, for example, on a home server. There is no commitment to uninterrupted access, unlimited storage, or the continuation of the service forever. The operator may stop, limit, or close the service at any time and without prior notice or with short-term notice.

The responsibility for backup belongs to you. Your guides and images should not be kept only on this platform; it is recommended to download / copy important content to your own device or other environments. In case of termination of the service or technical failure, there is a risk of data loss; you are deemed to have accepted this risk.

2. Data Controller and Contact

In terms of KVKK, your personal data is processed by the natural person (or the legal entity it belongs to, if any) who actually operates the service. For applications and questions: [email protected].

Note: Official information such as the identity and address of the operator may be shared as necessary for identity verification in applications.

3. Processed Personal Data

Within the scope of your use of the platform, the following data categories may be processed:

  • Identity / Contact: first name, last name, username, email address, date of birth (for age compliance and account info).
  • Company Info (Optional): company title when a company account is selected.
  • Account and Security: password (stored only as a one-way hash), technical logs related to session and security.
  • Content Data: texts belonging to the guides you create, uploaded images, drawing/annotation data (content stored on the server).
  • Third-party Login: when you choose to login with Google, identity information transferred from the relevant provider (e.g., unique user identifier, email).
  • Technical Data: IP address, browser/session information, limited logs for security and abuse prevention.

4. Purposes of Processing Personal Data

  • Creation, verification, and management of membership and user accounts;
  • Providing guide creation, editing, sharing, and viewing services;
  • Hosting and presenting uploaded images and related files;
  • Security, prevention of fraud/abuse, prevention of unauthorized access;
  • Fulfillment of legal obligations, providing information to official authorities (in cases of legal necessity);
  • Improving service quality and technical support processes.

5. Legal Grounds

Your data is processed based on the legal grounds of being necessary for the establishment or performance of the contract under KVKK Art. 5/2, fulfillment of the data controller’s legal obligation, legitimate interest (security and service continuity), and explicit consent where explicit consent is provided. The checkbox provided during registration is for confirming the clarification and documenting processing permission where necessary.

6. Transfer

Your data is stored in the server / hosting infrastructure for the provision of the service. When using login with Google, a redirection is made to the Google side in the OAuth process; in this context, Google’s own policies apply. Your data is not sold to third parties or shared for commercial purposes unless legally required.

7. Retention Period

Your data is generally kept as long as your account and the service continue. In case of your deletion request or account closure, it is deleted or made anonymous as far as technical and legal periods allow. If the service is terminated by the operator, data may be deleted within the framework of technical possibilities and legal requirements; long-term archive or backup guarantee is not provided.

8. Rights of the Data Subject (KVKK Art. 11)

Within the scope of the Law;

  • Learning whether your personal data is processed,
  • Requesting information if it has been processed,
  • Learning the purpose of processing and whether it is used in accordance with its purpose,
  • Knowing the third parties to whom it is transferred at home or abroad,
  • Requesting correction if it is incomplete or incorrectly processed,
  • Requesting deletion or destruction within the framework of the conditions stipulated in the KVKK,
  • Requesting notification of correction/deletion processes to third parties to whom it is transferred,
  • Objecting to the occurrence of a result against you by analyzing it exclusively through automated systems,
  • Requesting compensation for damages in case of loss due to illegal processing

9. Application

Rights can be exercised by applying through the contact details provided above. Applications will be finalized within 30 days as stipulated by KVKK.
